With approximately 300 individuals needing visa extensions in the first quarter of 2025 and numbers expected to peak in the second quarter, understanding the extension requirements and potential challenges is essential for those wishing to continue their Hong Kong journey.

The Top Talent Pass Scheme, launched in December 2022, has been tremendously successful, with over 100,000 applications approved and more than 70,000 visa holders already in Hong Kong as of June 2024. As these initial two-year visas begin to expire, holders must navigate the extension process to continue their stay.

TTPS visa holders can apply to extend their stay within four weeks prior to their visa expiry date. The success of your extension application depends on meeting the prevailing eligibility criteria, which primarily centers around:

  1. Having secured employment in Hong Kong

  2. Providing proof of business establishment or participation in Hong Kong

  3. Meeting the Immigration Department's qualification requirements

Unlike the initial application, which didn't require a job offer, the extension process focuses on your actual contributions to Hong Kong's economy through employment or entrepreneurship.


Common Challenges in the Top Talent Pass Extension Process


1. Employment Contract Limitations

One of the most significant challenges applicants face is that extension periods are directly linked to employment contract duration. Labor and Welfare Secretary Chris Sun Yuk-Han recently explained this approach:

"Let's say an applicant's visa expires in March, he finds a job, but the employment ends in September. We have no reason to give him a three-year stay."

In such cases, only a six-month extension would be granted. After those six months, if the employer renews the contract, an appropriate length of stay would then be provided. This creates uncertainty for talent who have short-term employment contracts.


2. Top Talent Pass Extension Documentation and Verification Hurdles

The Immigration Department conducts thorough reviews of qualifications and employment conditions or business operations before granting extensions. This increased scrutiny means applicants must prepare comprehensive documentation, including:

  • Detailed employment contracts

  • Proof of ongoing business operations

  • Employer-sponsored information

  • Verification of qualifications1

The verification process can be time-consuming and may require additional documentation if the Immigration Department has questions about your application.


3. Timing Concerns and Work Continuity

A critical challenge for many TTPS holders is the potential gap between visa expiry and renewal approval. If your renewed visa is not issued before your current visa expires, you must cease working or conducting business in Hong Kong until the new visa is issued1. This creates potential income disruption and professional continuity challenges, especially for entrepreneurs or freelancers.


4. One-time Application Limitation

Perhaps one of the most significant challenges is that if you decide not to renew your TTPS visa, you cannot apply for another TTPS visa in the future1. This "use it or lose it" policy means that your decision about extension has long-term implications for your Hong Kong immigration options.


Extension Patterns and Opportunities

With successful extensions, TTPS holders can generally expect to receive permission to stay on a 3-3 years pattern. However, there's a special provision for high earners: visa holders who have worked in Hong Kong for at least two years under the TTPS and have earned a taxable income of at least HK$2 million in the previous year's tax assessment may qualify for a longer six-year extension.

This creates a tiered system that rewards higher-earning professionals with greater visa stability, though meeting these thresholds can be challenging in a competitive job market.


Financial Considerations

Effective from February 26, 2025, an application fee of HK$600 will be charged for talent admission schemes, including TTPS extensions. Additionally, visa fees will be adjusted based on the duration of stay, increasing to either HK$600 or HK$1,300. While these fees are relatively modest compared to visa programs in other international hubs, they represent an additional consideration in the extension process.

Given the direct link between employment contract duration and visa extension length, negotiating longer-term employment contracts can provide greater visa stability. If your current arrangement is project-based or short-term, consider discussing contract extension options with your employer before applying for your visa extension.
